TERMS & CONDITIONS

 DEFINITIONS

(a) The “Owner” is Balloons & Beyond NZ 

(b) The “Renter” means a person who has personally signed this agreement, or has been signed on the renter’s behalf by an agent

(c) The “Goods” means soft play and any replacements and includes all accessories and other equipment.

(d) The “Rental Period” means the period beginning and ending on the date set out on the invoice provided by the Owner to the Renter.

 

Services

All services are provided by Balloons & Beyond “the Company” or “Us” or “We”.

 Any references within these terms to “You” or “the Customer” mean the person purchasing the goods as named on the invoice. By placing an order with us, you are accepting these terms in full.

 Following your enquiry, we may correspond with you via email, to provide you with examples of the types of designs / creations available. You are welcome to email any images / design ideas to us at bandb.partydecor@gmail.com

 Any correspondence between you and the Company during the planning stage is complimentary and you will not be charged.

 Once you have confirmed the design you want, we will provide you with a quotation via email , WhatApp , Instagram or Messenger.  Quotations are valid for 7 days following which prices may be altered or services may no longer be available.

 If, following review of the invoice, you wish to make any amendments to the agreed design, please email us at bandb.partydecor@gmail.com and set out your requested amendments. We will then send you a revised invoice via email.

 A booking can only be confirmed once we receive the non-refundable booking fee of 50% of the total price and the completed booking form. Bookings will be confirmed via email, WhatApp , Instagram or Messenger. 

 Should you fail to provide the non-refundable booking fee and completed booking form within 7 days of receiving the invoice the date will be released for alternative bookings.

 We will contact you 4-5 weeks before the event date to confirm the details and specifics of your booking e.g., dates and times.

 The balloons will be delivered 2 hours prior of the event to the event venue confirmed by you on the booking form. Should the venue have any special arrangements or restrictions it is your responsibility to ensure that you have confirmed those in writing to us at least 7 days before delivery. We will not be liable if the venue prevents set-up of the balloons , soft play or bouncy castle, and no refunds will be provided for items not used due to venue limitations.

 Once the balloons, have been delivered and set-up, we will have no further involvement on the day of the event. It is your responsibility to agree the location of the balloons at the venue in advance so that they are delivered and set-up in the correct place.

 Should you wish to hire any additional items, for example flowers, soft toys, such items will be hired and will remain the property of the Company throughout. Should any hire items be damaged or broken then an invoice will be raised for the cost of replacement item. All invoices for breakages must be paid within 7 days. 

Should hire items be broken or not returned by other clients of the Company in advance of the event and not available for your event date, the Company will use their best endeavours to source a similar replacement. We reserve their right to use a suitable alternative if any hire items are not available.

Pricing and Alterations to Bookings

 Quotations are unique to each client and represent the specifics of each booking which include factors such as seasonal availability.

 Quotes may be higher or lower for certain clients depending on various factors such as the complexity of the arrangement chosen which may impact the number of hours required in each circumstance.

 As far as possible the price quoted for the event will be correct (subject to no alterations being made). However, due to the nature of the balloon styling event industry and bookings being made so far in advance, from time to time it may be necessary to vary the price depending on the availability and price of certain components of your design. As part of our price promise to you, we will vary prices both upwards and downwards as required and never increase a price from the quotation (where all other elements are the same) by more than 10%.

 Should it be necessary to change the date of the booking then as much notice as possible should be provided and in any event not less than six month’s notice should be given. We will reschedule your booking if the alternative date you have chosen is available. You will be permitted one change to the date on the basis that the minimum three months’ notice is provided. Any further date alterations will incur further non-refundable booking fees. If we are unable to accommodate the alternative date, we will not refund the booking fees.

 Should it be necessary to change the scope of the booking by adding additional balloons or altering balloon styling you can do this at the final design consultation. Any additional costs will be added to the final invoice. Any reductions to the order will only be permitted up to 15% of the original quote.

PAYMENT AND BOND

The renter agrees to pay to the owner the amount of the rental charge set out in the invoice provided by the owner, including delivery charges if applicable) for the rental period, together with any applicable GST.

Payment for hire of goods must be made by 50% non-refundable deposit upon confirmation of order; and the balance of the agreed hire price made 3 days prior to delivery of the goods.

If, following payment of your invoice, you wish to purchase any additional balloons, you can do so at any time up to seven days prior to the event date. There is no guarantee that we will be able to fulfil your request, which is subject to balloon and product availability and the associated lead times.

Soft Play and Bouncy Castle only. A bond payment of $100 will be taken by the owner 3 days before the event date, and will be refunded upon return of the goods in a condition acceptable to the owner. 

Table, chairs and other goods. A bond of $50 will be taken by the owner 3 days before the event or pick up date.

Payment must be made by bank transfer or cash.

All orders placed less than 7 days from delivery require full payment to confirm the booking.

By making a booking through confirming a quote, deposit payment or remittance of funds, the Renter acknowledges and agrees to the Owners Terms and Conditions listed on the website. 

All prices on Balloons & Beyond website are in NZ Dollars. 

Cancelations 

The Renter is able to cancel an order but must forfeit any hire fees paid as follows:

If booking is cancelled 4 weeks before the event date, Owner will make a full refund of any hire fees paid minus the 30% deposit paid;

Bookings cancelled 1 - 3 weeks before the event date will forfeit 50% of the total hire fee. 

Bookings cancelled within 7 days of the event date will forfeit 100% of the total hire fee.

Please note we will NOT refund for hires cancelled due to wet weather on the day. Our soft play bundles can be set up outside on flat, dry grass or concrete but you MUST have an indoor/ covered option as back up incase of bad weather. A gazebo works well if you don't have indoor space. We will not set up outside if it is forecast to rain on the day of your event. Please keep this in mind when choosing your event location. 

Design Rights

We retain all design copyright in any creation prepared in the course of carrying out any Services on your behalf. We will not accept imitation or replication of our designs in any circumstances.

We trust that you will be delighted with the balloon arrangements and request that any images taken of our arrangements and shared on social media include credit to us by using our social media handle @balloonsandbeyond

 

Liability

Once an order has been delivered, you will be responsible for it, and we will not accept any responsibility for any loss or damage.

If the balloon arrangements are moved following set-up, we will not take responsibility for any loss or damage.

We do not take any responsibility for your balloon arrangements if they are damaged or altered as a result of hot weather. In the event that hot weather is forecast, we will contact you in the week before your event to advise whether any alterations should be made in order to preserve the design and integrity of the balloons in extreme weather conditions.

We do not accept any liability when it is not possible to deliver your order due to adverse weather or road conditions. Neither will the Company be responsible for any losses arising in circumstances where we become unable to deliver the services such as illness, bereavement, or circumstances beyond our control. In such circumstances we will make every effort to keep you updated and advised.

Any photographs on our website and social media accounts are illustrative only. Whilst we can aim to create similar designs, we cannot guarantee or confirm that the balloons provided will match any of our images or any images which you provide to us in the planning stages.

Please be aware that we use the highest quality balloons but there may be slight variations in colour and we cannot guarantee exact colour matches either to specific colours at your event or across each element of the design.

 Nothing within these terms will:

(a)      Limit or exclude any liability for death or personal injury resulting from negligence;

(b)      Limit or exclude any liability for fraud or fraudulent misrepresentation;

(c)      Limit any liabilities in any way that is not permitted under applicable law; or

(d)      Exclude any liabilities that may not be excluded under applicable law.

 

DELIVERY,  SETUP & COLLECTION

We require approximately 1.5 hours for Installation and again for Collection of our Soft Play Bundles because of the amount of pieces, please factor this in if you are hiring a venue.

We require approximately 2 hours for a decoration setup and 15 minutes for collection for any balloon decoration setup.

If you have booked soft play and balloon decoration, 2 and a half hours will be required prior to the event.   

Delivery included within 15KMs of our base in Avonhead. If you feel you might be out of this area please get in touch before booking and we will advise if there may be an extra travel fee.

Ultimate Bundle : For this bundle, we recommend a minimum of 29m2.

Value Bundle : For this bundle, we recommend a minimum of 24m2.

Basic Bundle : For this bundle, we recommend a minimum of 18m2.

Grab & Go balloon garland will be deliver for extra charge for a minimum of $90, Avonhead is the pick up area. 

RENTER'S OBLIGATIONS

Conditions of Hire and hire period 

The hiring of the equipment will commence from the Rental period. The Renter is entitled to use the equipment for the Rental Hire period. Any extension of the period must be agreed to by Balloons & beyond. 

Soft Play and bouncy castle are for a hire period of 4 hours. This commences from the start time of your event. 

The hire period for balloon decoration and all the goods that comes with it, will be determined  by the customer and agreed to by Balloons &  Beyond 

For Soft Play and Bouncy Castle , all pieces of equipment MUST remain as they were at setup and CANNOT be rearranged once setup is complete by us. This is an insurance requirement and must be adhered too.

Keep and return the goods in pristine condition;

Only use the goods as they would be used by a careful and prudent owner;

Not use the goods for any illegal purpose;

Report any damage to, or loss of, the goods to the owner immediately such damage or loss occurs.

Take their own precautions and stop using the goods in the event that the goods break down or becomes unsafe to use during rental period and take all steps necessary to prevent injury occurring to persons or property as a result of the condition of the good.

Contact the owner directly first regarding any issues concerning your order of the goods (whether as to quality, fit for purpose, delivery, quantity, quality or otherwise of the goods)

Parental Supervision of Children

Our soft play and decorations are not to be used without parental supervision at all times. The Renter agrees to communicate to all parents or carers at the event not to leave their child playing alone and to exercise parental supervision at all times.

The Renter acknowledges and assumes any risks and must take their own reasonable precautions and stop using the goods in the event that the goods becomes unsafe to use during rental period and take all steps necessary to prevent injury occurring to persons or property as a result of the condition of the good.

OVERDUE RENTALS
The renter will be charged additional fees (per day fees quoted on website) if the equipment is not returned upon the agreed timing stated in the invoice. The per day fees will be charged until the toys are returned completely. 

If the renter has not returned the goods at the end of the rental period and has not contacted the owner and arranged a separate return time with the owner within 48 hours since the rental period, the owner will consider the goods as non-returned and shall be entitled to keep the $100 bond payment and charge the renter the recommended retail value cost of the goods.
